The editor has just submitted this suggestion to the Pentagon Office of General Counsel's Military Justice Review Group:
There is a discrepancy between the new trial deadlines prescribed in Art. 73, UCMJ (2 years for newly discovered evidence or fraud on the court) and Fed. R. Crim. P. 33(b) (3 years for newly discovered evidence, 14 days for any other claim). The Review Group may wish to consider whether the discrepancy is warranted in light of the overall policy of conformity with district court practice where practicable.
