An Italian career soldier has surgery that he does not disclose to the army. He then deploys, becomes ill, and his surgery becomes known. He has to be medevaced back to Italy at a cost of €30,000, and is prosecuted for fraud. The prosecutor claims the state was damaged to the extent of the medevac costs and the special pay the accused received during the mission, and demands a sentence of nine months confinement. The defense argues lack of damage and lack of intent. What result? (Answer
