Yesterday, in its 17th decision of the October 2022 Term, the U.S. Court of Appeals for the Armed Forces, in an opinion by Judge
Liam P. Hardy, unanimously ruled in
United States v. Anderson, No. 22-0193, that the
Constitution's requirement that juries be unanimous does not apply to courts-martial. The decision, which addresses an issue that has been raised in numerous cases, is now subject to discretionary review by the Supreme Court.
