COVID-19 and military justice (Papua New Guinea)

Citing rampant misconduct by personnel of the Defence Force in the course of COVID-19 operations, a civilian judge in Papua New Guinea has imposed a three-years and six-months suspended sentence and a fine on an inebriated soldier who beat a civilian woman with a metal rod. National Court judge Panuel Mogish also recommended that the offender be dealt with under the Defence Act 1974. The Code of Military Discipline is found in Schedule 1 of the Defence Act. It provides in pertinent part:
Sch. 1.C13. Evidence of civil conviction.

A conviction of a criminal offence or an offence against the law of any place in which an accused person is or was at any relevant time serving may be treated, for the purpose of any disciplinary proceedings, as conclusive evidence of the facts found by the court or tribunal that convicted him.
