Canadian Forces lawyer's take on the Tindungan case

Major Eric Charland of the Office of the Canadian Judge Advocate General has written this article (presenting only his own views) on the decision of the Federal Court of Canada in Tindungan v. Canada, 2013 FC 115, for the Canadian Bar Association National Military Law Section's Sword & Scale newsletter. The case concerned whether the U.S. military justice system satisfies Canadian and international norms of independence. The article is part 1 of a planned two-part series.
