It takes four votes to grant certiorari at the Supreme Court of the United States. Today certiorari was denied in the al-Bahlul military commission case. A denial of certiorari has no precedential value. All of that said, it is incomprehensible that the justices would not grant review, regardless of how they intended to vote on the (important) merits.
