A businessman being held for military trial in Uganda since last year has challenged his military detention in the High Court. The government says he should bring his complaint to the general court-martial -- the very court he claims lacks independence. He's also seeking damages. Details
here.
Given
last week's decision of the Constitutional Court, the businessman would seem to have a good case. Ugandan human rights lawyer
Nicholas Opiyo cautions, however, that the government may appeal that decision to the Supreme Court and not comply with it while the appeal is pending.
