Considering how few cases the military commissions at Guantanamo have tried, they continue to generate interesting issues. The latest, as reported
here by the
Miami Herald's

Rosenberg, concerns whether automatic appellate review of the case of
Ibrahim al Qosi, who has been released from custody, can proceed if his post-release conduct shows him to be an alien unprivileged enemy belligerent. A factfinding hearing has been ordered.
