Delhi High Court awards Rupees 5.5 million to Air Force pilot who suffered injury in air crash

In a landmark decision, the Delhi High Court has awarded Rupees 5.5 million to a serving officer of the Indian Air Force who was injured in an air crash.

The High Court has held that exposure to a risk that was more than expected, even in case of the armed forces, amounted to violation of right to work in a safe environment, as was guaranteed under the fundamental right to life under the Constitution of India.

The Court of Inquiry into the air crash had revealed that the crash had occurred due to poor workmanship at a facility of Hindustan Aeronautics Limited (HAL).

While the Union of India would be paying Rs 0.5 million, the rest of the amount of Rs 5 million would be paid by HAL.
