The Interior Ministry of Pakistan has forwarded the first dozen cases to the Army for trials in the military courts authorized by the recently-approved 21st Amendment to the Constitution of Pakistan. Even though litigation is pending before the Supreme Court concerning the new courts, no formal request has apparently been made for a judicial stay of proceedings. The Court will therefore have to deal with "facts on the ground" rather than entirely theoretical issues. The Court is awaiting submissions from the Attorney General and the provincial Advocates General.
