Canadian soldier alleges physical abuse by his recruit instructor who is now charged with assault and abuse of subordinates

Ottawa.  A 43-year old soldier alleges that he suffered permanent injuries as a result of a physical assault by his recruit instructor during his recruit training which took place during the winter months of 2009/2010. His complaints to his chain of command were to no avail. Released on medical grounds, he sough legal assistance to pursue this matter. His lawyer advised the Vice Chief of the Defence Staff, the Judge Advocate General and the Provost Marshal in April 2012. A military police investigation ensured with charges being laid in January 2014 however, despite repeated requests for action, these have yet to be preferred by the Director of Military Prosecutions from the Office of the Judge Advocate General.

On October 16, 2014 the Director of Military Prosecutions, Office of the Judge Advocate General has preferred five [5] charges against Master-Corporal J. Franco Guarrnaccia as a result of his alleged assault against Robichaud and another recruit on the recruit course and allegedly harassing several of the other members of the said course.  The court martial is planned to take place in the Summer 2015.

• Third charge. Section 95 of the National Defence Act. Abuse of subordinates. (Victim: Another private recruit on the same course)

• Fifth charge. Section 129 of the National Defence Act. Conduct to the prejudice of good order and discipline for intimidating and harassing recruits,
